Selling a tenanted property in Mangawhai

Can the property be sold with tenants in place?

Yes. A buyer can take over as landlord and the tenancy continues on its existing terms. A sale does not itself cancel a tenancy. If vacant possession is proposed, obtain advice about the tenancy type, lawful notice and the settlement date before committing. A fixed-term tenancy cannot simply be ended early because the property has sold.

How should viewings and photographs be arranged?

Tell tenants in writing when the property is put on the market. Obtain permission for access by buyers and professionals, and for photography. Tenants may set reasonable access conditions and refuse photographs of their possessions; they may also refuse open homes and require appointment viewings. Agree the arrangements in writing and respect that this remains their home.

What information should you bring to the sale discussion?

Bring the tenancy agreement, relevant correspondence and the property information you hold. Explain your timing and whether you expect the tenancy to continue. Ask your lawyer and existing property manager what the proposed sale means for your obligations, access and settlement. Your sales agent can use that discussion to plan presentation and viewings without promising an outcome that has not been agreed.

What happens if the buyer becomes the landlord?

Landlord contact details and the bond record need updating. The tenant needs to know who is taking over and how to contact them. Coordinate the handover with the existing manager, buyer and legal advisers.
